Why not EPO Vice-President Wim Van der Eijk? An excellent and loyal diplomat with a deep knowledge of the patent system. He should be embarrassed if he does not get the job offered and did great work in many debates to listen to scientists and stakeholders from all sides, just think of his well respected work with the STOA process of the European Parliament. He confronted all the crucial governance questions where the EPO requires leadership to reform itself. Wim Van der Eijk looks like the perfect candidate to follow Alison Brimelow unless she gets convinced to change her mind.
It's now official. The candidates for the next EPO presidency are:
- Ms Susanne AS SIVBORG (Sweden), Director General of the Swedish Patent and Registration Office
- Mr Benoît BATTISTELLI (France), Director General of the Institut National de la Propriété Industrielle
- Mr Roland GROSSENBACHER (Switzerland), Director of the Swiss Federal Intellectual Property Institute
- Mr Jesper KONGSTAD (Denmark), Director General of the Danish Patent and Trademark Office
I agree with previous comments that both Mr. Grossenbacher and Mr. Kongstad would not be warmly greeted by EPO staff. Obscenely, this is actually in their favour as the appointing authority, The Administrative Council, is less than supportive towards the EPO staff and goes to great lengths to dismantle the great achievements of previous Presidents of the EPO that understood the need for centralisation within the context of supporting a common European market.
Considering the CV presented by Ms. Sivborg, she does offer a very broad level of experience. http://www.epo.org/about-us/events/archive/2008/pi-conference2008/biography.html but is this sufficient given the political horse trading that goes on behind the scenes during such elections? I doubt it.
If Kongstad is selected, I expect EPO employees to be very, very angry. He's been quite vocal about what he thinks about them.
As somebody strongly opposed to decentralisation, I'd be quite annoyed too. This said, the DK-PTO, with its aggressive quest for "market share", is in such an odd position, that I doubt many other AC members will be ready to support him. It isn't that many eyebrows are raised at the AC at an NPO acting in its self-interest, but that may be a problem when that self-interest is so much at odds with that of a majority of other NPOs.
I don't see why decentralisation is so bad. Just stop paying the NPOs any money and let them compete with us on equal terms if they are so convinced of their own value and importance.
