Breaking News: EU Council has formally adopted Draft Directive on Patentability of CII.
Heise Newsticker has just now reported [in German only, sorry] that the EU Council has eventually formally adopted the political agreement on the Draft Directive on the patentability of computer-implemented inventions as of May 2004.
Dear Mr Horns. I know that as a patent attorney You see a lot of benefits from this leagal act which was "adopted" yesterday, forgive me this "argumentum contra personam" but it fits somehow into Your considerations about "Stallmans Utopia". But as a well educated man You should know that such legislation process itself legitmize FFII or other anti "software patent" organization to sue this Directive to the Court of Justice of European Communities. Forgive me please not to join You into deliberations about what computer implemented inventions should be patented, or how the EU law should be made and if it is needed.
Now that the stupid Lux presidency has misguided and lied in public about the unwritten rule, we can really sue them for denying B-item requests. Presidency decided alone, or misguided by diplomats which cannot read Council Rules of Procedure.
I was thinking Luxembourg presidency was much more careful than that.
