EPLA Final Draft published.

The

Swiss Patent and Trade Mark Office IGE

reports that the working group on litigation and its subgroup has been working on a

draft proposal for a European Patent Litigation Agreement and a

statute for a European patent court for the past four years

According to the working group, the draft is now sufficiently completed that it can be presented to a diplomatic conference. However, because of the ongoing work being done regarding the Community patent, the group did not feel in a position to convene such a meeting. The Administrative Council of the European Patent Organisation is meeting December 8, 2004 and the working group intends to meet immediately afterwards to reevaluate the situation regarding a diplomatic conference. I guess it will be very interesting to see if the

collapse of the deliberations on the EU Community Patent might cause a revival of the EPLA.
